Lincoln and tried to use committee investigations to force the president to change the composition of the cabinet.

Consequently, the viability of parliamentary committees was confirmed during the Civil War. The active activity of specialized congressional bodies had by then become an inherent feature of the American model of separation of powers and the system of “checks and balances”.

By the mid-19th century, the committees of the U.S. federal legislature differed significantly from their counterpart in the English parliament. The core of the congressional committee system was made up of permanent specialized bodies of the chambers that had the right of initial consideration of bills, were not bound by mandatory instructions from the leadership, and exercised both legislative and supervisory powers. While the committees of the British Parliament remained subsidiary bodies operating under the strict control of the Houses, the congressional committee system played an important independent role in shaping the policies of the Senate and House of Representatives.

The evolution of congressional committees during the period of pre-monopoly capitalism was above all related to the development of contradictions within the ruling bourgeois-plantationist bloc. Disagreements between the president and congress, ultimately reflecting these contradictions, usually did not affect the basic functioning of the state apparatus, but had a direct impact on the work of its individual parts, including committees. The use of the specialized bodies of the chambers for reaching agreements and working out political compromises, their role of intermediaries between the Congress and the departments were determining factors in the development of the system of committees of the supreme representative institution. The creation of a stable House structure helped the ruling circles to ensure continuity in the main directions, forms and often methods of work of the Congress, while the revision of the composition of committees repeated at the beginning of each session reflected changes in the political orientation of the houses.

By the mid-19th century, the committees had become the voice of the leading party factions. Legally, they stood apart from the party factions because they were appointed by the official leadership of the houses from representatives of all political groups represented in the congress. In fact, the composition of the committees in those years was already selected by the party factions, and the appointment of the chairman and the determination of the committee majority depended directly on the balance of party forces in the chamber. At the same time, it was to the congressional leadership’s advantage to give the committees’ decisions the character of professional rather than political recommendations. Thus a discrepancy gradually emerged between the legal position and the actual role of the specialized bodies of the supreme legislative institution. The rapid development of capitalism in the 20s and 40s put new social forces at the center of the political struggle. The process of the industrial revolution, a decisive factor in social development, brought to the forefront a clash between two factions of the bourgeoisie: the commercial-financial one and the nascent industrial one.

Party regrouping led to the emergence of a new two-party combination. Although Democratic Party supporters had a majority in both houses of Congress during the “Jacksonian Democracy,” the position of the emerging Whig Party in the Senate was quite strong. The different balance of political power in the congressional chambers had a direct impact on the work of the committees.

The most influential senators (such as G. Clay and D. Webster) tried to remove the vice-president from forming committees. “The Executive Prodigy” was “allowed” to appoint their members only when elections did not result in a significant renewal of the Senate and did not significantly alter the party’s balance of power. The president of the upper chamber had only to reaffirm the continuity of the committees and extend previous appointments.

In the House of Representatives, by contrast, all three previous speakers supported the head of state and selected committee members so that the bills needed by the president were considered and approved as soon as possible. In defending himself against accusations of excessive obedience to Jackson, Speaker Bell said that he was operating on the principle articulated by President J. C. Adams: for our government to be useful, its various bodies must not only coordinate their work, but also cooperate with each other. It was not by chance that this interpretation of the theory of the separation of powers came from the lips of the leader of the House of Representatives. The innovations introduced by Jackson forced the working bodies of Congress to consider the president’s position to a greater extent than before.

General Jackson’s candidacy for head of state was not nominated by party caucuses. Though the constitution determined that the president gets his powers through an extraparliamentary system of indirect elections, until the 1920s the election of the head of state was nevertheless connected to the representative body, because the party caucuses of the congressional houses decided the question of candidates for the post of president. With the change of the procedure of nominating candidates for the highest state office, with the replacement of the caucuses by the convention system, the president gained greater independence from the legislature.

Jackson has consistently used the constitutionally granted veto power of the president for political purposes. (In the first 40 years of the independent American state, presidents refused to sign bills passed by Congress only nine times, and only three vetoes were over important bills. It has become the conventional wisdom that the president can veto a bill only if it is not in accordance with the constitution.) Jackson, subverting the established practice, used the veto 12 times in eight years and used the pocket veto for the first time. Since the president could finally decide the fate of a bill approved by an absolute majority of the House and Senate, one of the primary tasks of the committees was to ascertain the position of the executive branch on all controversial details of the bills. The passage in Congress of the Department of the Interior bill is illustrative. At the request of the Ways and Means Committee, the bill was examined and finalized in detail by the Treasury Department, and the specialized body of the House of Representatives merely adopted the recommendations of the department.

In an effort to subordinate the workings of the entire state machinery to their interests, the Democrat leadership put forward the idea of “the spoils belong to the winners” and refused to take merit into account in selecting candidates for federal government agencies. A purge of federal employees was carried out, and for the first time Jackson applied on a large scale the previously known practice of patronage – the appointment of his supporters to positions. The composition of the executive branch was substantially renewed (1/5), with changes primarily affecting the top ranks of the federal administration. This greatly undermined the basis of the power of the Capitol committees – longstanding, strong ties with the departments. So the committees now sought to establish direct contact with those in the president’s inner circle, and mainly with his unofficial advisers – members of the first “kitchen cabinet. Specialized House bodies began to select their own staff. It was during the period of “Jacksonian democracy” that the first mention in House rules of paying committee clerks was made.

In order to be more aware of the enforcement of laws, Senate and House committees expanded the system of regular departmental reports on financial reporting. Thus, from 1836 onward, each House began to summarize the appropriations to the executive on the basis of the data furnished by the ministries. Investigations continued to be an important instrument of political struggle. They were generally conducted on the most important issues that were causing division between Democrats and Whigs. Their formation is a general pattern of bourgeois parliaments’ activity, caused by the objective necessity of labor division in the supreme legislative body. Parliaments are numerous in their composition, the volume of their work is extremely large, and deputies are not able to solve all the issues at sessions of the chambers, so there is a need for auxiliary bodies. The system of committees, firstly, frees the chambers from considering an excessive number of cases; secondly, provides an opportunity for thorough examination of an issue, creates conditions for both specialization of MPs and involvement of experts from outside; thirdly, the committee system facilitates the work of representative institution, since examination of issues in each of the committees is carried out according to simplified rules.

The Constitution of 1787 consolidated the power of the ruling classes – the bourgeoisie and the planters, establishing their undivided dictatorship, but the question of the distribution of power within the bloc of ruling forces still needed to be resolved. On the one hand, the ruling classes, facing the threat of a possible deepening of the revolution, sought to consolidate political forces, and the interests of strengthening the national state apparatus required this. On the other hand, the heterogeneity of interests among the various factions of the ruling classes and the sharp ideological struggle over the question of the way forward for capitalism in the country gave rise to opposing tendencies and had a considerable influence on the formation of the US central bodies as a whole and of Congress in particular.

Initially, Congress took as its model the activity of the English Parliament, colonial legislative assemblies (Legislatures) and continental congresses. The main instrument of discussion and decision-making in each of its two houses was the Committee of the Whole House on the State of the Union, a body composed of all the deputies of the house, but chaired by a specially elected person, rather than the Speaker in the House of Representatives or the Vice-President in the Senate. In accordance with the perceived norms of the English legislative process, every important proposal that came before Congress was initially debated in detail by a committee of the whole House, and then referred with specific instructions to a temporary committee, a body that was created specifically to deal with a particular issue and dissolved after a report before the House. Then the deputies again discussed the proposals in a committee of the whole chamber, where they made decisions taking into account the position of the provisional committee. And only then, with further additions and amendments, it was submitted to the plenary session of the Senate or the House of Representatives. Such a long procedure revealed its shortcomings from the very beginning. The deputies complained that the extensive use of a committee of the whole chamber was a waste of time, delayed the legislative process, and reduced its efficiency. However, at the first stage of the development of an independent state, when the mechanism of power distribution within the ruling bloc was yet to be worked out, the use of a committee of the whole chamber helped to reveal the interests of the main factions of the bourgeoisie and planters. The collegial consideration of questions made it possible to work out a compromise solution and unite the political forces in Congress: on the one hand, to secure the interests of the majority of the ruling classes and, on the other hand, to give the minority equal rights in the discussion of the most important problems.
